School Employee Gets Probation for Asbestos Violations
A former Messena, New York School District employee who pleaded guilty in February to violations of the Clean Air Act involving asbestos has been sentenced to two years probation.
According to a News 10 Now story, Benny Gladding was sentenced to probation involving two different counts. The first was for providing false information to a federal agent about asbestos removal and the second involved preparing a false report involving asbestos in district buildings. Gladding will be on probation for two years on each of the counts, but will serve those years concurrently.
Gladding was also ordered by the court to serve 100 hours of community service for his involvement in asbestos violations at the Jefferson Elementary School.
Gladding, age 48, was terminated from his position as the Buildings and Grounds Superintendent for the Massena School District earlier this year. He could have been sentenced to as much as six years in prison and a fine of about $350,000.
"The serious part was that we found illegal asbestos removals that occurred during the course of quite a few years and reports that didn't show that there had been these removals. And, laboratory samples that showed friable asbestos in places it was supposed to be within the schools and that of course is a very serious problem," said Craig Benedict, Asst. U.S. Attorney, during the trial in February.
